*The safety of our racers is our primary concern. Racers are expected to be able to ski all terrain at Nashoba Valley ski area competently. Racers may be asked to refrain from racing until the coaches determine they have the skill necessary to race safely. Parents of children under 8 years old or under 48” tall meeting ski ability requirements should be prepared to ski with their child to assist with loading and unloading the chairlift on both Practice and Race Days.

Nashoba Agreement 1

NASHOBA SKI AREA 2017-2018 Racing Season Medical Authorization and Liability Agreement:

NO SKIER WILL BE ALLOWED TO PARTICIPATE UNLESS THIS FORM HAS BEEN RETURNED TO THE CLUB WITH A PARENT’S/GUARDIAN’S SIGNATURE WITH ALL EMERGENCY MEDICAL INFORMATION PROVIDED. NO EXCEPTIONS. I hereby authorize the directors, officers or other persons designated by the Nashoba Valley Ski Club, Inc. to seek and/or authorize emergency medical treatment for my child, including x-rays, when recommended by a hospital or physician. This authorization covers any and all injuries occurring to my child while participating in the Eastern Mass Buddy Werner League ski program.

I agree, for myself and/or my child, to RELEASE, forever indemnify, defend, and hold harmless Nashoba Valley Acquisition Corp, Nashoba Hill Corp and their owners, officers, directors, volunteers, employees, affiliates, agents and assigns, (collectively as “RELEASEES”) from liability for any and all loss or damage to myself or to my child or my or my child’s property resulting from the RELEASEES’ NEGLIGENCE or any other cause. I understand that the RELEASEES are not responsible for the consequences of their own NEGLIGENCE, that is, their failure to use reasonable care in any way. I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damage, personal injury and death in connection with my or my child’s use of the resort or the snow tubing facility.

For myself and my child, I agree to RELEASE, indemnify, defend, and hold harmless the RELEASEES from any and all loss or damage that I or my child may cause to persons or property while using the resort or the snow tubing facility. This includes, but is not limited to, any and all claims for personal injury, death and/or property damage that may in any way arise out of use of the resort or the snow tubing facility.

I further agree, for myself and/or my child, to release and give up any and all claims and rights that I and/or my child may now have against Nashoba Valley Acquisition Corp, Nashoba Hill Corp. This releases all claims, including those of which I and/or my child am not aware and those not mentioned in this release. This release applies to claims resulting from anything which has happened up to now.

This agreement is governed by the applicable laws of Massachusetts. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect. In the event that any provision is found to be invalid, the provision shall be revised so that it is enforceable to the greatest extent possible. I agree and understand that any claim or lawsuit against the RELEASEES may be brought in the federal or state courts of Massachusetts only.

PARTICIPANTS UNDER 18 YEARS OF AGE: AS PARENT/GUARDIAN SIGNING THIS AGREEMENT FOR THE ABOVE NAMED MINOR, I ACKNOWLEDGE AND AGREE THAT I HAVE READ THE ABOVE RELEASE OF LIABILITY AND THAT BY SIGNING THIS RELEASE ON BEHALF OF THE MINOR, I AND THE MINOR AGREE TO BE BOUND BY ITS TERMS. I HEREBY AGREE TO RELEASE FROM LIABILITY, FOREVER DISCHARGE, INDEMNIFY AND HOLD HARMLESS RELEASEES FOR ANY CLAIM OR SUIT ARISING OUT OF SAID MINOR’S USE OF THE RESORT OR THE SNOW TUBING FACILITY.

Bogastow Community Ski Team

Supplemental Operation Plan for 2020-2021

This document describes Bogastow Community Ski Team’s supplemental operations plan, as an Activity Organizer, including new safety protocols for training and competition during the COVID‐19 pandemic. This remains in effect as long as circumstances require these extra precautions.

Chapter 1 Safety Responsibilities

Bogastow Community Ski Team Board Members

The Board Members of the Bogastow Community Ski Teamare responsible for ensuring, to the best of their abilities’, that the policies and regulations for Youth and Adult Amateur Sports Activities put forth by the Massachusetts Executive Office of Energy and Environmental Affairs (EEA) are followed at all times.

Bogastow Community Ski Teamwill also use the 2020‐21 COVID‐19 Alpine Policies and Procedures put forth by US Ski & Snowboard as guidance.

The Bogastow Community Ski Teamwill be assigning a dedicated parent or coach to monitor social distancing and compliance with protective actions, as well as prompt other staff and athletes about social distancing, hand hygiene, and the use of face coverings. They will be there to assist coaches and to make sure that good social distancing practices are maintained for the duration of the practice or race. Coaches, Volunteers and Racers

Coaches, volunteers, athletes are expected to comply with the guidelines for Youth and Adult Amateur Sports Activities and any other guidelines set forth related to Massachusetts Ski Area Operations or by Nashoba Valley Ski Area.

Coaches will be responsible for explaining the policies and precautions outlined in all documents pertaining to returning to play during COVID‐19.

If ANY athlete, coach, volunteer, fan becomes ill with flu like symptoms (see below) OR has been in contact with someone who is sick, they are asked to please remain home and follow the Massachusetts Health Dept guidelines. If tested positive or deemed to be in close contact with a person who tested positive please contact the Bogastow Community Ski Team COVID‐19 Coordinator immediately so all who have been in contact or close range to the individual can be notified. Because COVID‐19 can be spread from an asymptomatic person, cooperation in this matter is greatly appreciated for the safety and health of everyone.

All event participants will be required to attest that they meet all health requirements for participation ahead of each team event. For minors, which is the case for the majority of team membership, a parent or guardian will need to complete the attestation.

Chapter 2 Personal Contact/Hygiene

●Wash your hands often with soap and water for at least 20 seconds, especially after you have been in a public place, or after blowing your nose, coughing, or sneezing.

●If soap and water are not readily available, use a hand sanitizer that contains at least 60 percent alcohol. Cover all surfaces of your hands and rub them together until they feel dry. Avoid touching your eyes, nose, and mouth.

●All coaches, volunteers, racers, other event participants, etc., are required to wear PPE whenever applicable per Massachusetts state guidelines; PPE such as cloth face coverings which cover nose and mouth must be worn at all times per Massachusetts COVID‐19 Order NO 53 and per Bogastow Community Ski Team policy.

Athletes

●Athletes and coaches should take measures to prevent all but the essential contact necessary. This should include refraining from handshakes, high fives, fist/elbow bumps, chest bumps, group celebrations, etc.

●No Sharing of Equipment and Food. Do not share water bottles, food/snacks or any ski equipment with any other racer.

Spectators & Volunteers

●All spectators and volunteers are required to follow the Massachusetts guidelines for social distancing, more information can be found here: https://www.mass.gov/info‐details/covid‐19‐prevention‐and‐ treatment#social‐distancing‐The key points are as follows:

○Stay six feet away from individuals outside their household

○Wear a cloth face covering

○Avoid direct hand or other contact with athletes/coaches/everyone during any event.

○A spectator or volunteer with any of the symptoms outlined by the CDC in the Symptoms of CoronavirusOR who have had known contact with an individual testing positive for COVID‐19 should not attend a practice or race. https://www.cdc.gov/coronavirus/2019‐ncov/symptoms‐testing/symptoms.html

Chapter 3 Ski Area Facility Access

As the lodges and other facilities of the ski area will follow the Massachusetts State Guidance for Restaurants or other policies of their own making; access will be limited.

●There will be no storage of equipment in or around the base lodges or any other external facility on the premises; equipment is expected to be stored in your vehicle.

●Racers, coaches and volunteers need to show up to the facility ready to practice/race and use their vehicle as a base lodge.

●Event participants should plan for an all-outdoor event

●Policies and procedures for access to restroom facilities will be provided and managed by the ski area

Chapter 4 Scheduling

●The Bogastow Community Ski Team along with Nashoba Valley Ski Area will schedule sufficient time between practices and races to facilitate the complete evacuation of individuals from a previous practice or race from the premises before the next group enters.

●Athletes, coaches, and spectators are instructed not to show up to the venue more than 15 minutes before their scheduled practice/race time.

●An “arrive, play, and leave” mentality will be promoted to ensure that individuals are not congregating in common areas or parking lots before, during or following practices or events (such as tailgating).

Chapter 5 Lifts

●Bogastow Community Ski Team will adhere to the Nashoba Valley Ski Area policies.

Chapter 6 Races

●Per the US Ski and Snowboard Alpine Competitive Guidance, races will be limited to a maximum of 100 athletes per event.

●A Bogastow Community Ski Team representative will be required to keep track of all in attendance during races and must provide that information to Nashoba Valley after every race

●Registration/Bib Distribution will need to be scheduled to ensure proper social distancing can be achieved

●To prevent crowding, there will be no scoreboard or posting of results at Bogastow Community Ski Team events

●To prevent crowding, there will be no awards ceremonies at Bogastow Community Ski Team events

Nashoba and EMBWL Agreement 2

I/we, the parent(s) or guardian(s) of the child named on this form, who is participating in the Eastern Mass. Buddy Werner League racing program, give my/our approval for his/her participation in any and all club activities. I/we assume all risks and hazards incidental to such participation, including transportation to and from such activities; and I/we do hereby waive, release, absolve, indemnify, and agree to hold harmless NVSC and the Eastern Massachusetts Buddy Werner League (“EMBWL”), their organizers, officers, sponsors, supervisors, officials, participants, and person transporting my/our child to and from activities, from any claim arising out of any injury to my/our child. My/our child has my/our permission to participate in practices and races. I/we understand that by signing this waiver, I/we agree that neither NVSC, the EMBWL, nor its organizers, officers, officials, managers, or other members or activity participants are liable for injury to my/our child in connection with the season’s activities.

Physical Condition

I am physically fit to participate in the Event(s) in which I have chosen to participate, and have not been advised to otherwise by a medical practitioner.

In exchange for the right to participate in the competition and the services of the above mentioned Wachusett Mountain Associates Inc. the participant expressly and freely agrees as follows:

In consideration of being allowed to participate in ski racing activities and/or use of the Air Bag, for myself and/or my child, I agree to RELEASE, forever indemnify, defend and hold harmless Wachusett Mountain Associates, Inc., and their owners, officers, directors, volunteers, employees, affiliates, agents (collectively as “Releases”) from any and all claims for personal injury, death and/or property damage to myself or my child resulting from the RELEASEES NEGLIGENCE.I understand that the RELEASEES are not responsible for the consequences of their own NEGLIGENCE, that is, their failure to use reasonable care in any way.I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damage, personal injury and death in connection with my or my child’s participation in the competition and event.

Volunteer

In order to make our race days run successfully it is required that ALL parents volunteer at our home races. Descriptions of roles can be found at www.Bogastowski.com and in the Parent’s Guide. Prior experience is not necessary. Training will be provided.

We will send out the volunteer roles and schedules once available.  This will be managed through the Bogastow web portal.
